General
Atwatch is designed to help webmasters, web managers and web teams improve the performance, content, availability, and user experience of their web site(s). If we identify that a customer intentionally misuses or abuses our service we have the right to cancel the account. Please use @watch for its intended purpose.
Customer Responsibility
Subscribers to @watch services must have the authority to correct site problems or access to those making decisions about the web site. For @watch to provide accurate and timely information, the site needs to be regularly maintained. Sites that need an extended period of time to repair should suspend their account until the problem is corrected. Members can suspend their account for a given period of time in Log In (Member Services). We ask that problems on your site within your control be corrected within five working days. This provides a better service for all.
If you do not respond to alerts or the problems are not corrected in that time period, @watch reserves the right to cancel or suspend your account (we will alert you before we take this step). If at any time you do not understand an alert, please contact us at support@atwatch.com
By starting or continuing your subscription, you agree to the following conditions and authorize @watch to send you email containing reports, alerts, and information pertaining to your web site as well as email regarding @watch services and news.
1) Anti-SPAM Policy
@watch maintains an aggressive policy against SPAM, or UCE (Unsolicited Commercial email).
2) Acceptable Content
@watch makes no effort to censor information or content at our customer's sites. The customer acknowledges that @watch will not be held liable for any actions not specifically endorsed or encouraged by @watch. We will not monitor sites with offensive material or illegal content. @watch reserves the right to not offer service to any company or web site.
3) Re-Instatement fee
@watch reserves the right to charge a service setup fee to reinstate canceled accounts.
4) Billing errors
If you believe @watch has billed you incorrectly, you must contact us via email or in writing no later than 90 days on or after the date of the first billing statement in which the error or problem occurred.
5) Account Cancellation
To unsubscribe, you must contact @watch via fax, postal mail, e-mail, or phone or use the unsubscribe button in the Log In (Member Services) at www.atwatch.com. If the information provided to @watch for an account cancellation does not match the accounts' records, cancellation may be delayed or prevented. All charges for services already rendered on date of cancellation notice must be paid in full before a cancellation will be considered complete. Service charges will extend to the end of the month in which the account is canceled.
6) "As Is" Services
The customer acknowledges that all @watch services are provided "as is". Should any damage, computer virus, or other problems occur, @watch shall not be held liable. In no event shall @watch be held liable for any indirect, incidental, or other consequential damages, (including lost profits) arising out of or in relation to this subscription or agreement or the customers' use or any one's inability to use @watch services.
7) Free Trial Offer
The @watch Free Trial is designed to allow companies to understand the @watch service. The period of the trial is 14 consecutive days. After the trial, the account will be suspended but will remain accessible for a period not to exceed 30 days. The Free Trial is offered for 1 (one) URL only per company. Exceptions are handled on a case-by-case basis and only with the approval of @watch.
8) Policy Changes
The Company's usage policies are subject to change at any time without notification.
COPYRIGHT
All materials appearing anywhere on @watch's Internet site (www.atwatch.com) are protected by worldwide copyright laws and treaty provisions. The copyright on such materials is held by Atwatch.com or by the original creator of the materials. None of the materials may be copied, reproduced, modified, published, uploaded, posted, transmitted, or distributed in any form or by any means other than as described by @watch or with @watch's prior written permission. All rights not expressly granted herein are reserved. Any unauthorized use of the materials appearing on @watch's Internet site may violate copyright, trademark and other applicable laws and could result in criminal or civil penalties.
PATENTS
The Atwatch engine is a proprietary software system protected by the patent laws of the United States and Canada. The patent was filed in September, 1998 and was issued by the PTO at January 28, 2003. It covers the engine design and engine functionality.
TRADEMARKS
All trademarks or service marks are property of their respective owners. @watch and is a registered trademark of Atwatch.com.
SERVICEMARKS
"Who's watching your Web Site", "Protecting business online", "We're at watch when you can't be", and "Protected by @watch" are service marks of @watch and Atwatch.com.
TERMS AND CONDITIONS
Payment for services is accepted in advance by credit card during the registration / activation process. We accept all major credit cards including, Visa, MasterCard, American Express, Discover, and Diners Club. There is no surcharge for using your credit card to purchase @watch services. Please be sure to provide your exact billing name, address, telephone number, credit card number and
expiration date that corresponds with what your credit card bank has on file for you. Incorrect information may cause a delay in watching your site. Your credit card will be billed on the billing week of your " anniversary date " for the upcoming month, quarter or year of service, depending on the option you selected. Your service will be automatically renewed at the end of each service period unless it is terminated. It is important to update and maintain current credit card information on file. Services will be provided upon activation and payment.
SERVICE AND SUPPORT
All requests for service support should be made initially to support@atwatch.com. We will make every
attempt to address your problem within a 24-hour period.
OUR COMMITMENT
We watch web sites for our customers 24 hours a day, 365 days a year. When we see problems we send alerts via email, pager, and fax. Our engine is designed to identify and avoid false alerts. Information about site performance is based on averages and it should be understood that measuring anything on the Internet is not an exact science. The Internet is growing and changing daily and therefore all performance information should be used as a guideline and not an absolute.
